
Five Star Shipping & Agency Company Privacy Policy
The Company adheres to the National Privacy Principles which came into effect on 21 December 2001. The company has adopted the following policy in relation to collecting, using, keeping secure and disclosing personal information.
Collection of personal information- The company will not collect personal information about an individual unless the information is necessary for one or more of the company's functions or activities.
- Collection of personal information will be by lawful and fair means and will not be obtained in any unreasonably intrusive way.
- The company may collect personal information from individuals in writing, electronically or by telephone. Personal information may include an individual's name, address, credit card details and information about an individual's financial circumstances.
- The company collects personal information for the purpose of performing its contracts with individuals, for assessing an individual's credit worthiness and for marketing the company services to its customers and to prospective customers.
- The company discloses personal information to third parties such as freight forwarders and the Company's principle, COSCO for the purpose of carrying out its contract with you or where an individual's account is in default for the purpose of instructing a collection agent to recover the debt.
- Individuals can access any personal information held about them by the company by contacting the company's Privacy Officer whose details appear at the conclusion of this Policy.
- The company may use and disclose personal information it has collected for marketing purposes. This could include placing an individual's name and contact details on marketing lists for use by the company or its related companies for the purpose of offering goods or services from the company or a related company.
- An individual may make a request to the company's Privacy Officer not to receive direct marketing communications. The company will not charge for giving effect to an individual's request not to receive direct marketing communications.
- Individuals should be aware that in certain circumstances, such as where health and safety issues are involved or for the purposes of law enforcement, the company will be entitled to disclose an individual's personal information without their prior consent.
The company will take reasonable steps to ensure that the personal information it collects, uses or discloses is accurate, compete and up to date by doing the following:
- Verifying customer personal information with the customer when contacted by the customer, whether provided in writing or over the telephone;
- Updating a customer's personal information on the company's computer databases;
- The company will take reasonable steps to protect any personal information it holds from misuse and loss and from unauthorised access, modification and disclosure. The company ensures that only authorised staff have access to personal information held by the company.
- The company will take reasonable steps to destroy or permanently de-identify personal information if it is no longer needed for any purpose for which the information may have been collected.
- This Privacy Policy on the company's management of personal information is available upon request. This policy is also posted on the company's website.
- On request by any person, the company will take reasonable steps to let the person know generally, what sort of personal information it holds, for what purpose/s and how it collects, holds, uses and discloses that information in accordance with the National Privacy Principles.
- An individual is entitled to request access to personal information the company holds about the individual except in certain limited circumstances as set out in the National Privacy Principle number 6.1. The circumstances include where disclosure would constitute a threat to life or health, or would impinge on another's privacy or where the request is frivolous or vexatious or where access would be unlawful or where denying access is authorised by law.
- The following procedures have been put in place to provide individuals who have information held by the company with their personal information on request:
- Any request for personal information should be directed to the company's Privacy Officer whose contact details appear at the conclusion of this Policy. The Privacy Officer will respond to this enquiry.
- If an individual is not satisfied with the response, the request will be referred to the General Manager. If the individual remains unsatisfied with the response, any further complaint should be directed to the Privacy Commissioner.
- In its discretion, the company may charge for providing access to an individual’s personal information. These charges will be advised at the time the request is made and before the request is processed. The request may not be processed if the company's reasonable fees are not paid by the individual requesting access.
- If the company establishes that personal information about an individual is inaccurate or incomplete it will take reasonable steps to correct the information.
- The company will provide reasons if it denies access or refuses to correct personal information.
The company will not adopt as its own identifier of an individual an identifier of the individual that has previously been assigned by an agency; agent of an agency or contracted service provider for a Commonwealth contract acting in its capacity as contracted service provider for that contract.
AnonymityWherever it is lawful and practicable, individuals will have the option of not identifying themselves when entering into transactions with the company.
Trans-border data flows- The company may transfer personal information about an individual to someone (other than the company or the individual) who is in a foreign country only if:
- The company reasonably believes that the recipient of the information is subject to laws of the same standard or greater than the National Privacy Principles; or
- The individual consents to the transfer;
- It is impracticable to obtain consent or there is a likelihood consent would have been given;
- The transfer is for the benefit of the individual;
- The transfer is necessary for the performance of or conclusion of a contract or pre-contract between the individual and the company.
Should the company collect sensitive information about an individual, the company will obtain the individual's consent before doing so. Otherwise the company will not collect sensitive information unless it is required by law or the collection is necessary for the establishment, exercise or defence of a legal or equitable claim.
